Terms and Conditions

Welcome to https://wildcaughtsalmon.net (the "Site"), operated by Wild Caught Salmon Kodiak
Alaska LLC ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your
access to and use of our Site and Services. By using our Site, you agree to be bound by these
Terms.
1. Acceptance of Terms
By accessing, browsing, or using our Site or purchasing our products, you acknowledge that you
have read, understood, and agree to be bound by these Terms. If you do not agree, do not use our
Site.
2. Eligibility
- You must be at least 18 years old to make purchases.
- We only sell and ship products within the United States.
- You are responsible for complying with local laws in your jurisdiction.
3. Accounts
If you create an account, you agree to:
- Provide accurate and complete information.
- Maintain the confidentiality of your login credentials.
- Accept responsibility for all activities under your account.
We reserve the right to suspend or terminate accounts for misuse or false information.
4. Orders and Payments
- All orders are subject to acceptance and product availability.
- Prices are listed in U.S. dollars and may change without notice.
- Payments are processed securely via GoDaddy and its integrated partners.
- You authorize us to charge your selected payment method for orders you place.
5. Shipping and Risk of Loss
- We ship perishable products in insulated packaging with cold storage methods.
- Risk of loss passes to you once we deliver products to the carrier.
- We do not guarantee delivery times. Delays caused by carriers, weather, or other circumstances
outside of our control are not our responsibility.
- You must promptly inspect deliveries and place items in frozen storage.
5A. Regulatory Compliance & Shipping Notice
You acknowledge and agree that:

1. Federal Compliance (Seafood HACCP). We handle, store, and distribute fishery products in
accordance with applicable U.S. federal regulations, including the FDA's Hazard Analysis and
Critical Control Point (HACCP) requirements for fish and fishery products (21 C.F.R. Part 123).
2. Traceability (FSMA). Where applicable, we maintain traceability records consistent with the FDA
Food Safety Modernization Act (FSMA) requirements for listed foods and will provide such records
to authorities as required by law.
3. Labeling Accuracy. We label products in accordance with applicable federal law (including
species/common name, net weight, and "wild-caught" or origin statements where applicable). You
are responsible for reviewing any labels and following all handling instructions.
4. State Restrictions / Invasive Species. Certain states restrict shipment, possession, or sale of
particular aquatic species (including some fish, shellfish, or roe). You are solely responsible for
ensuring that any product ordered is lawful to receive and possess in your jurisdiction. We may
cancel any order we believe may violate federal, state, or local law.
5. Customer Responsibilities. Upon delivery, you must promptly inspect, properly store (frozen/cold),
and safely prepare products. Failure to follow safe handling practices may increase the risk of
foodborne illness and void any remedy described in these Terms.
6. No Warranty of Jurisdictional Compliance. We make no representation that any product is legal
for import into your specific jurisdiction. Your order constitutes your representation that the product is
lawful for you to receive and possess; you assume all risk for any violation of local rules.
7. Right to Refuse / Cancel. We may refuse, suspend, or cancel an order at our discretion if we
determine shipment would be unlawful or inconsistent with these Terms.
8. Indemnification (Shipping Compliance). In addition to the indemnification in Section 12, you agree
to defend, indemnify, and hold harmless Wild Caught Salmon Kodiak Alaska LLC from and against
any claims, penalties, or losses arising out of (a) your failure to comply with federal, state, or local
laws governing shipment, receipt, possession, or use of products; or (b) your failure to follow safe
handling, storage, or preparation practices.
6. Returns and Refunds
- All sales are final. Due to the perishable nature of seafood and meat products, we do not accept
returns.
- If your shipment arrives damaged, thawed, or unsafe, contact us at
customersupport@wildcaughtsalmon.net within 24 hours with your order number, photos, and a
description of the issue.
- Replacements or credits are issued at our sole discretion.
7. Acceptable Use
You agree not to:
- Use the Site for fraudulent or unlawful purposes.
- Interfere with or disrupt the Site's functionality.
- Attempt to gain unauthorized access to our systems.
- Use automated scraping or bots, except for search engine indexing.
8. Food Safety Disclaimer
You are responsible for following all storage and preparation instructions for seafood and meat
products. We are not liable for any illness, injury, or damages resulting from failure to properly store,

handle, or prepare products after delivery.
9. Intellectual Property
All content on the Site, including text, graphics, images, logos, and software, is owned by Wild
Caught Salmon Kodiak Alaska LLC or its licensors. You may not reproduce, distribute, or use our
content without prior written consent.
10. Disclaimer of Warranties
The Site, products, and services are provided "AS IS" and "AS AVAILABLE."
We disclaim all warranties, express or implied, including merchantability, fitness for a particular
purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, consequential, or punitive damages.
- Our total liability for any claim shall not exceed the amount paid for the product giving rise to the
claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Wild Caught Salmon Kodiak Alaska LLC, its
affiliates, officers, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the Site or Services;
- Your violation of these Terms; or
- Your violation of any applicable laws or third-party rights.
13. Arbitration and Class Action Waiver
- Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site
shall be resolved by binding arbitration administered in Georgia, rather than in court.
- You agree that disputes will be conducted only on an individual basis, and you waive any right to
participate in a class action lawsuit or class-wide arbitration.
14. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict of law
principles. Any disputes shall be resolved exclusively in the state or federal courts located in
Georgia.
15. Modifications
We may update or modify these Terms at any time. Updates will be posted on this page with a
revised Effective Date. Your continued use of the Site constitutes acceptance of any changes.
